This course introduces students to the foundations and evolution of EU environmental law, tracing its development across six phases and examining the key legal principles that guide it, such as subsidiarity, proportionality, integration, and precaution. It explores the objectives and principles enshrined in the Treaties, the legal bases for environmental action, and the relationship with other EU policies, including energy, agriculture, transport, and trade. Students will analyse harmonisation methods, the implementation and enforcement of directives, and the role of the Commission. The course also addresses legal protection, focusing on direct effect, consistent interpretation, state liability, and access to justice under the Aarhus framework. Finally, it considers the intersection of environmental protection with the free movement of goods and competition law.
